Reports: Milan and Inter request ‘criminal shield’ in San Siro discussions – the reason

There has been a strange clause sought by AC Milan and Inter in the San Siro discussions, and the City Council have somewhat agreed.

With the progress of the new San Siro getting further than any project before it, there is a lot of precaution being taken by all parties. For example, not all parties are stating it is a done deal yet, even with everything being agreed upon, as there are further processes.

Perhaps that will only be done once the stadium and plans are ready. Either way, there is an agreement in place, and the club can progress.

A criminal shield?

It has been a long few months of negotiations, and there have been some strange requests in the process. Milan previously asked for a San Donato clause to allow them to pursue the stadium in the future. As you would imagine, it was quickly rejected.

Nevertheless, the parties sought an agreement within the agreement, as La Repubblica and Corriere della Sera write, via Milan Press.

According to the two papers, there was a ‘criminal shield’ hoped to be put in place, which would protect things against criminal proceedings, which could ‘block work or negatively impact the bankability of the operation’.

The Municipality made a counter proposal, but the parties agreed on the following, within the completed agreement:

“The parties—in the event of investigations—agree to meet to evaluate the solution, seek to safeguard the effectiveness of the contract, and assess the possibility of terminating the contract. If investigations or criminal proceedings that impede the project’s bankability and thus the start of construction are initiated within the first nine months of signing the sales contract, either party may withdraw from the contract within the following 30 days, with the GFU being returned and only the consideration paid being reimbursed.”
